The Biden administration later ended the practice, but Trump officials argue the ruling could restrict future border enforcement efforts.

Solicitor General John Sauer told the court that immigration authority belongs to Congress and the executive branch, not the judiciary. He argued the lower court decision weakens the government’s ability to manage border crossings and asylum claims.

The Immigration and Nationality Act allows migrants physically present in the United States to apply for asylum if they fear persecution in their home country.

The metering policy began during the Obama administration in 2016 amid a surge of Haitian migrants at the San Ysidro port of entry. It was later expanded under the Trump administration, directing border agents to limit the number of asylum-seekers allowed to enter the country.

In 2019, Trump officials also introduced a rule denying asylum to migrants who traveled through other countries without first seeking protection there.

Immigrant rights groups, including Al Otro Lado, challenged the policies in court, arguing they illegally blocked vulnerable migrants from accessing asylum protections.

A lower court sided with asylum-seekers and issued an injunction restoring claims denied under the policy.
